Buy America(n) (BAA) and Build America Buy America (BABA)

Guidance For Federal Domestic Procurement Regulations

Many projects include provisions that require procurement of domestic products. These requirements typically apply to U.S. federal projects but may also apply to state or municipal funded projects. These projects require compliance with either Buy America(n) (BAA) or Build America, Buy America (BABA).

BAA is the traditional Buy America or Buy American program for government agencies that have a Buy America or Buy American program in place. These are longstanding programs which we normally see through direct federal government procurement under the Federal Acquisition Regulations or FAR, the Defense Federal Acquisition Regulations or DFARS, or the various Department of Transportation Regulations through Federal Transit Administration, Federal Highway Administration, Federal Aviation Administration, and Federal Rail Administration.

Does your project need BAA?

BABA was enacted as part of the Infrastructure, Investment and Jobs Act (IIJA) in November 2021. BABA established content procurement preference for all federal financial assistance obligated for infrastructure projects after May 14, 2022. In its final state, all iron, steel, manufactured products, and construction materials used in infrastructure projects must be produced in the United States for use of federal funding established through IIJA.
